The Fannie/Freddie debacle brings many “teachable moments.” One of the classes we can sign up for is “what’s wrong with corporate employment contracts” - or what’s right with them, if you happen to be the executive who’s got one. As Michelle noted yesterday, the feds said they wouldn’t try to recover compensation from departing Fannie CEO Dan Mudd [...]

If all your HSE and training documents are only in English, you could be leaving yourself wide open under the Corporate Manslaughter act. It appears to pay to translate if you use migrant workers who may have English as a second language. Does this apply to Employment Contracts as well? Will all our documents have to be [...]

In a decision that has interesting repercussions for the web industry, the California State Supreme Court has ruled that non-compete clauses in employment contracts are not enforceable in California. Non-competes, for those who have never dealt with them, restrict employees who leave their existing jobs from taking a similar role in another company or to start [...]

California’s highest court has ruled that a common feature of employment contracts called a noncompete agreement is illegal under state law and has been since 1872. The California State Supreme Court has ruled that non-compete clauses in employment contracts are not enforceable in California. I'm reminded me of the study from the Duke Center for the Public Domain that concluded that the reason that the tech corridon on Route 128 near Boston had grown so much more slowly than Silicon Valley was that Massachusetts has enforceable non-competes, while California does...

Amazing that Pat Powers did not learn from my post regarding employment contracts, such as that of his wife, not falling within the restrictions of IM10. Instead he puts up a post yesterday titled, "Wait a minute. IM10 doesn’t just...

Many hospitals, state medical boards and physician employment contracts have reference to disqualification for "moral turpitude." We can all conjur up some concept of moral depravity which would legitimately give rise to collective disgust and a refusal to share comity with the offender. The State Medical Board of Ohio appears...
