Efforts by the timber industry and the Bush administration to lift protections for a rare West Coast seabird that nests only in old growth forests have been soundly rejected by two different courts. A federal judge in Washington, DC, and the Ninth Circuit Court of Appeals both ruled in favor of retaining federal Endangered Species Act protections for the marbled murrelet.
